Terms of Use

transferly.swiss (hereinafter referred to as the Service) respects the rights of others and requires the same from its users. These Terms of Use define prohibited and tolerated behaviour or content for the use of the Service. If the Service believes there is reason to suspect that you, as a user of the Service, may be violating these Terms of Use, the Service reserves the right to take the necessary measures or actions to prevent violations in the short, medium, and long term. These Terms of Use may be regularly amended and modified.
1. Access and Use of the Service
- In general, by using the services offered by the Service, a user agrees to strictly comply with these Terms of Use.
- Extended use of the Service requires registration, by which a user undertakes to:
- Provide correct, current, and complete personal data
- Review such data regularly and keep it up to date
- We reserve the right to review your data from time to time for completeness and accuracy.
2. Restrictions
- A user must have reached the age of 18 in order to use this Service.
- A user may not own more than one free account. It is not permitted to maintain multiple accounts in order to obtain additional storage space.
- Free accounts may only be used for private purposes.
- For commercial use of the Service, paid accounts (e.g. Pro and Business) must be registered.
- Paid subscriptions are available for:
- Users with residence or registered office in Switzerland or Liechtenstein (B2C and B2B)
- Companies with registered office in the European Union (B2B)
- For companies established in the European Union, the use of paid subscriptions is only permitted with a valid VAT ID. Billing shall be carried out under the reverse charge mechanism, provided the applicable requirements are fulfilled. It is solely the responsibility of the company to declare and remit any VAT due on services. The provider reserves the right to restrict access to paid functions if these requirements are not fulfilled.
3. Terms of Use
- As a condition of using the Service, the user agrees not to upload or share any data that:
- depicts child pornography
- is obscene, defamatory, libellous, profane, offensive, or unlawful
- promotes racism, violence, or hatred
- is factually inaccurate, false, misleading, or deceptive
- the user has no right to copy, use, and/or transmit
- infringes or abuses intellectual property rights, privacy rights, including data protection laws (in particular the processing and/or disclosure of third-party personal data), and/or other rights
- violates applicable laws or regulations
- constitutes “hate speech”, whether directed at an individual or a group and whether based on race, gender, belief, national origin, religious affiliation, sexual orientation, or language of such person or group
- facilitates or promotes gambling or the sale or consumption of alcoholic beverages, tobacco products, or illegal drugs; and/or
- otherwise violates applicable laws
- The user further agrees not to misuse the Service. Among other things, the user agrees to refrain from the following actions:
- accessing or using the Service in a manner intended to avoid applicable fees, consume an unreasonable amount of storage space, or exceed the limitations of your service plan
- using unauthorised means to modify, redirect, or gain access to the Service or unauthorised data
- accessing the Service with unauthorised software
- damaging, disabling, overloading, or impairing the Service or any network connected to the Service
- using the Service directly or indirectly to offer a service competing with the Service
- probing, scanning, or testing the vulnerability of any system or network
- taking actions or participating in actions that could impair or disrupt the efficiency of the Service
- transmitting software or data containing viruses, malware, trojans, spyware, or other malicious software or program code
- transmitting chain letters, spam, junk mail, phishing emails, unsolicited promotions, or advertising of any kind and for any purpose
- The user is prohibited from pursuing or carrying out the following actions:
- selling, reselling, or renting the services or the software
- removing, obscuring, or altering notices relating to transferly.swiss trademarks or other intellectual property appearing on or contained within the services
- modifying, copying, manipulating, or otherwise creating derivative works of the software or the services
- analysing, reverse engineering, disassembling, or decompiling the software or the services, or applying other processes or procedures to derive the source code of any software of the services
4. Fair Use
- The user is expected to use the Service in a manner consistent with normal and everyday use. Excessive use and strain on the system shall be considered no longer “fair” use and shall be throttled or prevented by the Service accordingly. In the event of repeated occurrences, the Service reserves the right to terminate the user and temporarily or permanently exclude them from the Service.
5. Abuse
- The Service aims to provide a serious and secure service. For this reason, users of the Service are obliged to report any suspicion or certainty of abuse or a violation of these Terms of Use to the Service as quickly as possible by email (abuse@transferly.swiss).
- If a user suspects unauthorised access to their account, the user must immediately change their access credentials and report such suspicion to the Service. The user remains responsible in all cases for all actions carried out using their account.
- The Service reserves the right, in cases of suspected abuse, whether due to suspicious behaviour, an abuse report, or a violation of these Terms of Use, to analyse the incident using all data available to it (see Privacy Policy) and, at its sole discretion, take such action as it considers appropriate, such as deleting content suspected of being unlawful and blocking or terminating the relevant accounts.
6. Access, Credentials & Data
- The user is obliged to protect their access credentials in accordance with the current state of technology and to keep them inaccessible to third parties.
- The Service is not in possession of the encryption keys of individual data transfers and therefore cannot access the decrypted data. If a user loses such encryption keys, the unencrypted data cannot be restored. The user may not hold the Service responsible for any resulting data loss.
- Uploaded and shared data shall be automatically deleted by the Service after the selected time period (“Expiration”). No backups exist and therefore no restoration is possible. The user has no claim for damages of any kind.
7. Copyright Protection
- The Service respects the rights of others and requires the same from its users. The Service shall, where possible, respond to notices of alleged copyright infringements where they comply with applicable law and have been properly submitted to it.
- The Service shall take any measures it considers appropriate at its sole discretion, such as deleting content allegedly infringing rights and blocking or terminating the affected accounts.
